The Moonaya app team welcomes you and informs you that, out of our keenness to protect Users, the app seeks to safeguard the information of Merchants and Users in accordance with the privacy and confidentiality of information policy in force in the app. This document has been prepared to clarify the mechanism of data protection and privacy in the Moonaya app, and to specify the approved controls for handling information. Therefore, please review it, as your use of the app means your agreement to what is stated in the privacy and confidentiality of information policy.

Definitions

1. (The Moonaya app): this term refers to the Moonaya app, and this definition includes all forms of the Moonaya app in the internet space, whether an application or a website.
2. (The Merchant): this term refers to every merchant who registers with the Moonaya app to create their electronic Store, whether a natural or legal person, and this definition includes all aspects of the Store as long as they conduct their trade through the Moonaya app, including the Store's website or application.
3. (The Electronic Store): this term refers to the Store used by the Merchant or the practitioner in the Moonaya electronic app, including the electronic Store's website or application.
4. (The Consumer): this term refers to every consumer who purchases a product or service from the electronic stores registered in the Moonaya app.
5. (The User): this term is used to refer to any person who uses the Moonaya app, whether a Merchant, a practitioner, or a Consumer.

The Information the Moonaya App Obtains and Retains in Its Electronic Systems

1. The User's personal information: such as the name, email, and mobile number.
2. The Merchant's or the User's personal information: such as the name, email, national identity number or residence (Iqama) number, and place of residence address.
3. The information relating to the Store and its legal entity: such as the commercial register number and a copy of the commercial register, or the freelance work license number and a copy of the license and the bank account certificate "the IBAN."
4. The login information of the electronic Store: such as the username, the password, the email, and the security question for password recovery and its answer.
5. The Moonaya store uses cookies (Cookies) to improve the user experience and to provide customized services.

Contacts You Choose to Import from Your Device

1. The contacts import feature is entirely optional. The Moonaya app never reads the contacts stored on your device unless you open the Contacts screen and choose "Import from Phone," and it asks for your explicit consent before it does so.
2. If you consent, the Moonaya app uploads to its servers only the display name and phone number of each contact stored on your device. It does not upload photographs, email addresses, postal addresses, notes, or any other field of a contact record.
3. The Moonaya app uses these names and phone numbers for one purpose: to match them against the events published on the Moonaya app, so that it can show you which of your contacts have an upcoming occasion and allow you to follow that occasion and send a gift.
4. The uploaded contacts are stored against your own Moonaya account only. They are not shown to any other User, are not sold, and are not shared with advertisers or with any third party, except where clause 3 of "Sharing of Information" below obliges the Moonaya app to do so.
5. You may delete every imported contact at any time from the Contacts screen of the app ("Delete all imported contacts"). Doing so also withdraws your consent, so that you will be asked again before any future import. Deleting your account deletes all of your imported contacts as well.
6. You confirm that you have the right to share the contact information you choose to import, and you may withdraw your consent at any time by the means described in clause 5.

Stores' Revenue, Products, or Services Information

1. The Moonaya app is continuously informed of the revenues of the stores, because the Store uses the payment gateways made available by the Moonaya app.
2. The Moonaya app is informed of the type of products or services displayed in the Store.
3. The Moonaya app is informed of the performance of the stores, in the event the need arises to direct support or advice and guidance to the stores to assist them and improve their performance.

Information of the Stores' Consumers or the Merchants' Customers

Since the Moonaya app seeks to improve the experience of the stores and improve the quality of their business, it continuously reviews the number of the stores' consumers and their purchase operations.

Sharing of Information

1. Naturally, the Moonaya app seeks to retain this information in a manner that preserves the User's privacy, and the Moonaya app does not retain this information except for the purpose of improving the quality of the platform and the quality of the stores' work, and for facilitating and easing the services.
2. As a general rule, none of this information is reviewed except by some of those in charge of the Moonaya app, and that is after they obtain a permit to review it from the management of the Moonaya app – usually the permit is specific and restricted and is subject to legal and administrative oversight by the Moonaya app.
3. Since the Moonaya app seeks to preserve a safe environment for practicing e-commerce, then – in the event the Moonaya app observes any unlawful or illegitimate activity carried out by the User – the Moonaya app, in application of the articles, clauses, and provisions of the Terms of Use Agreement and the privacy and confidentiality of information policy, may share any of this information with the competent authorities to take the necessary action regarding the violating User, and that is out of the Moonaya app's commitment to the controls and provisions of the regulations in force in the Kingdom of Saudi Arabia, including by way of example and not limitation the E-Commerce Law, the Personal Data Protection Law (PDPL), and the Anti-Cyber Crime Law.
4. The Merchant or the practitioner who takes the initiative to register their store with the Moonaya app by means of a success partner thereby grants the success partner through whom they registered the right to review all the information relating to the Store.
5. The Moonaya app notes that the unlawful practices of any of the Users result in the sharing of their data with the official authorities or some private entities such as: banks.
6. The User knows and agrees that the Moonaya app may use the information they provided to it, to send marketing messages.

The Extent of Security of Users' Confidential Information

The Moonaya app seeks to preserve the confidentiality of the information of the app's users, but given the impossibility of guaranteeing that 100% in (the internet space), the Moonaya app team notes the following:

1. The Moonaya app seeks to preserve all the information relating to the Users and that it not be reviewed by any person in violation of the policy in force in the Moonaya app.
2. The Moonaya app has worked to protect Users' information under high-quality electronic and technical protection systems that are updated continuously and periodically.
3. However, given that the internet network cannot be guaranteed 100% due to what may occur of breaches or viruses to the electronic protection systems and the firewalls in force in the Moonaya app, the Moonaya app advises Users to keep their information completely confidential, and not to disclose any information the User deems very important to them, and this is out of the Moonaya app's keenness to protect, direct, and guide Users.
4. The Moonaya app seeks to protect the personal data of its users in accordance with the highest standards, and in the event of any security breach that leads to unauthorized access to or manipulation of personal data, the app undertakes to notify the competent authorities immediately, as well as to notify the affected Users of the details of the breach, and the app will also take all the necessary measures to address the breach.

Strategic and Logistics Services (Third-Party Services)

The User expressly and in advance acknowledges and agrees that, in some cases, the "Moonaya" app may need to share some relevant information with third parties among the providers of strategic or logistics services, including – by way of example and not limitation – shipping companies, payment solution providers, or technical service providers, for the purpose of enabling them to carry out the tasks and provide the services related to the Store or the operations related to it.

This information is shared only within the limits of necessity and in a manner that achieves the legitimate purpose associated with the service, and in accordance with the provisions of the Personal Data Protection Law in the Kingdom of Saudi Arabia, and the platform undertakes to ensure the commitment of the relevant service providers to maintaining the confidentiality of the information and not using it except for the specified purpose.

Integration with Google Services

Within the framework of the Moonaya app's keenness to provide integrated services to Merchants, practitioners, and Users, the feature of integration with Google services has been activated, for the purpose of facilitating the synchronization of products and managing the stores' data in a secure and organized manner.

1. Granting Permission and Access to Data

When the Merchant grants explicit permission through the authentication mechanism approved by Google, the Moonaya app accesses specific data from the Merchant's Google account, including by way of example and not limitation:

• The registered product and inventory data (such as product identifiers, prices, descriptions, quantities).

2. The Purpose of Data Processing

This data is used only for the purpose of enabling the technical integration between the Merchant's store in the Moonaya app and their account in Google, including:

• Creating, updating, or synchronizing product listings.
• Managing the connection and authentication between the two systems.

3. Data Protection and Regulatory Compliance

The Moonaya app affirms the following:

• Google user data is used for the purposes specified above only, and in a manner that achieves the Merchant's legitimate interest in improving the experience of their electronic store.
• The data is retained for the period necessary to achieve the purpose of its collection, in accordance with the general privacy policy in force in the Moonaya app, or is deleted upon the User's request, upon cancellation of the integration, or upon removal of the app.
• The Moonaya app complies with all the provisions of the Personal Data Protection Law in the Kingdom of Saudi Arabia and its executive regulation, including the application of the necessary security, confidentiality, and privacy standards to protect the data when integrating with any external services.

Users' Rights Regarding Personal Data

The Moonaya app is keen to protect the privacy of its users and to provide clear mechanisms for exercising their rights related to personal data, including exercising the following rights:

1. The right of access: the User has the right to review the personal data stored about them by the Moonaya app.
2. The right of correction: the User has the right to amend or update their personal data to ensure its accuracy and completeness.
3. The right of destruction: the User has the right to request the deletion or destruction of their personal data if there is no longer a need to process it.
4. The right to withdraw consent: the User has the right to withdraw their consent to the processing of their personal data at any time.

Rules and Terms of Use of the Moonaya App

All the obligations of the Moonaya app, all the obligations of the Users, and all the rights contained in the relationship between the User and the Moonaya app, (are found in the Terms of Use Agreement), and we note that all dealings that take place between the Merchant and the Consumer have no relation to the person of the Moonaya app, and the Moonaya app is not responsible for them.

These rules are the "Privacy and Confidentiality of Information Policy," and they have been established to guarantee the credibility and trust that the Moonaya app is keen to provide to all Users.
